Have you or a loved one been diagnosed with thalassemia in New Jersey and suspect you may have been affected by medical negligence? You may be entitled to compensation for your suffering. This blog post explores how a New Jersey thalassemia attorney can help navigate medical malpractice claims specific to thalassemia diagnoses and treatment.
Understanding Thalassemia and Medical Malpractice
Thalassemia, a genetic blood disorder affecting red blood cell production, can significantly impact your life. A delayed or missed thalassemia diagnosis can lead to serious health complications. If you believe you’ve been harmed due to a medical professional’s negligence, understanding the legal concept of medical malpractice in New Jersey is crucial.
There are four key elements that your attorney will need to establish to win your case:
- Duty. A doctor-patient relationship creates a legal duty for the healthcare provider to act in your best interest and provide a reasonable standard of care. This standard is based on what a reasonably prudent doctor of the same specialty would do under similar circumstances.
- Breach of duty. This element refers to the doctor failing to uphold the established standard of care. A breach could involve various actions or omissions, such as misdiagnosing a condition, prescribing the wrong medication, performing unnecessary surgery, or failing to order appropriate tests.
- Causation. You need to show a clear connection between the doctor’s breach of duty and your injuries. Your attorney will have to prove that the doctor’s negligence, and not some other unrelated factor, caused your harm.
- Damages. Medical malpractice can cause a wide range of damages, including physical pain and suffering, emotional distress, lost wages, mounting medical bills, and even permanent disability. To win your case, you’ll need to provide evidence of the specific damages you’ve incurred due to the doctor’s negligence.
A New Jersey thalassemia lawyer can investigate your case and determine if there are grounds for a medical malpractice claim. If so, they will handle the complex legal process of filing a lawsuit and pursuing compensation for your pain and suffering, lost wages, and future medical expenses.
New Jersey Thalassemia & Medical Malpractice: Understanding Different Types of Negligence
Thalassemia presents unique challenges, and navigating the healthcare system can be complex. If you suspect medical negligence contributed to your thalassemia diagnosis or treatment, a New Jersey attorney can be a valuable resource. Here’s a look at different types of negligence related to thalassemia:
- Misdiagnosis or delayed diagnosis. A doctor failing to order appropriate tests, misinterpreting test results, or overlooking key symptoms can lead to delayed diagnosis. A delay can worsen the severity of thalassemia and limit treatment options.
- Improper treatment. Once diagnosed, a healthcare provider may choose the wrong treatment course, administer medications incorrectly, or fail to monitor side effects adequately. These actions can cause further health complications.
- Failure to inform about genetic testing. In some cases, doctors may neglect to discuss genetic testing options with couples considering pregnancy. A lack of information can prevent informed decisions about prenatal care and family planning.
- Blood transfusion errors. Thalassemia often requires regular blood transfusions. Errors in blood type matching, transfusion procedures, or monitoring for transfusion reactions can lead to serious health risks.
The impact of medical negligence in thalassemia cases can be significant. If you believe a healthcare provider’s actions deviated from the expected standard of care and caused you harm, consulting with a New Jersey thalassemia attorney can help you understand your legal options and potentially seek compensation for your suffering.

Thalassemia Case Highlight
A prenatal testing facility failed to properly perform genetic testing in a case that settled while the jury was still deliberating. A couple who was looking forward to starting a family were each a carrier of an inherited blood disorder, Beta Thalassemia, which they wanted to make sure wasn’t present in their unborn child.
With both parents being carriers, they knew how important it was to rule out the far more serious Beta Thalassemia Major. As advised, they submitted a sample of placental tissue to determine whether the baby was going to be impacted by the disease, which would determine how they would proceed. However, the defendants failed to properly perform the essential genetic testing that would have indicated the presence of the catastrophic Thalassemia Major disease, which in fact manifested in the baby.
Instead, they had incorrectly told the family the baby would only be a carrier; the parents continued with the pregnancy only to learn too late that the infant girl had the more serious disease, which caused a failure to thrive. It was determined that the prenatal testing lab failed to follow their own protocol when doing the initial testing. Key information was provided by a board certified doctor in molecular genetics who concurred that had the lab followed their own rules and standard operating procedures, it would have revealed their mistake. The venue for the case was Alabama.
After a two week trial, and while the jury was deliberating, the case settled for $8 million. (Attorney Paul O’Connor handled the case.)
