When we talk about wrongful birth we’re talking about a broad category of potential claims in which a person has not been given adequate information as to the nature of the pregnancy and the difficulties or abnormalities that the child is likely to be born with. That can involve a doctor simply failing to advise a patient of appropriate testing that should be done during the pregnancy, so as to advise them of the likelihood of developing or delivering a child with these genetic deformities. It can be the result of a laboratory who simply fails to run the appropriate test that has been ordered. So there are a lot of different ways in which a woman may not be given all of the information she should be given so as to make an informed choice as to whether she wants to continue with her pregnancy.
